Who should get a 1099-MISC Form?

Form 1099-MISC reports the payments made to other people in the context of a business except those made to employees.

If you are a self-employed individual, you can file and receive 1099-MISC forms and it depends on the nature of your business also.

If it’s compensation in exchange for products and services, then you need the 1099-NEC.

Landlords are typically tasked with filing 1099-MISC for payments they make to property managers, contractors, attorneys, repairmen, and any person who performs services for your property. If these payments are $600 or more that is when you are tasked with reporting more.

You must also file Form 1099-MISC for each person whom you have withheld federal income tax under backup withholding rules, and it does not matter what amount.

You must send 1099-MISC o a recipient in January 31 or the following business day.

The due date for filing Form 1099-MISC is February 28, 2022, and if you file on paper.

How many copies of the 1099-MISC should I have?

The first copy goes to the IRS. If your state has taxes then you also need to send it to the state tax department.

2nd copy goes to your independent contractor. You may also send them the appropriate tax statements.

The 3rd copy is for you and your personal records.

What information is in 1099-MISC?

Not just payments are included in 1099-MISC but some other pertinent info too including your name, address, your social security number and employer identification number or EIN. 1099’s classify these payments in separate boxes on the form and it hinges on the reason for payment.

How much income is required to file 1099-MISC?

If you don’t belong to the threshold of $600 above, you are not required to mail a 1099-MISC form for your independent contractors.

How do I know my employees are independent contractors?

It depends, usually, it involves the amount of operational control you have on the job. Are there written contracts also including pension, insurance and health benefits?

If they occasionally work for your company and you don’t garner as much creative control in the way they perform their jobs, then you can consider them as independent contractors.
